On November 2, a draft amendment to the Criminal Procedure Law of the PRC was submitted to the Standing Committee of the National People's Congress for its first review. It proposes to explicitly write for the first time that 'no person shall be found guilty without a judgment by a people's court in accordance with the law, and presumption of guilt is prohibited,' and intends to restrict the application of residential surveillance in designated locations. Scholars warn that adding these six characters requires a systematic upgrade of provisions regarding evidence and the right to defense.
