Prosecutors argued that Zhang Moujun's long-term stable cohabitation with and care for Bu Mou, a missing female master's student suffering from schizophrenia and lacking the capacity for sexual self-defense, constituted "forming a family and living together," which is "fundamentally different" from the crime of rape, and thus decided not to prosecute. His collection of a 40,000 yuan "adoption fee" for giving away a child was also deemed a private adoption and not a crime.
