Sunset Pirate: Analysis and Review of the Killing of Female Judge Wang Jiajia in Henan

A female judge in Henan, Wang Jiajia, was murdered, her throat slit. Thanks to media reports, we have a relatively clear description of the background of the incident.

Before her death, Judge Wang Jiajia presided over a traffic accident case. In this case, the traffic police ruled that the driver was entirely at fault. The driver accepted the traffic police's ruling and transferred responsibility to the insurance company.

The victim's side compiled evidence of medical expenses, lost wages, and nutritional costs after being hit by the car, demanding 18,000 yuan in compensation from the insurance company.

The insurance company did not object but stated that a court procedure was necessary for complete claims processing.

Thus, both parties went to court and met the judge. The judge then asked both parties to first attempt civil mediation instead of proceeding with a judgment. Those who have never been to court may not know that before a civil lawsuit in China, courts often require the plaintiff and defendant to first engage in "mediation." If mediation fails, the case proceeds to litigation, ostensibly to promote the construction of a socialist harmonious and law-based society. Moreover, the success rate of mediation is a hard KPI for many courts. When I myself was involved in a lawsuit years ago, because I refused mediation and insisted on a court judgment, a "people's mediator" at a certain court directly told me in the court office:

"It's such a trivial matter, why are you suing? Are you out of your mind?"

I then returned with my phone recording and said to the "people's mediator": "Say that again."

From my personal experience, Chinese courts indeed do not welcome ordinary people bothering the authorities with "trivial matters." This is the background. Now, back to the traffic accident case in Henan.

During the mediation of this case, the amount offered in mediation did not meet the victim's expectations, so mediation broke down, and a court ruling was to be made. Note that the victim in this case came from a very, very poor family. After being hit, the doctor recommended he be hospitalized for 29 days, but he couldn't afford the medical expenses and had to go home to recuperate.

Then the trial began. With the driver being entirely at fault and the insurance company admitting liability, our judge, Wang Jiajia, who according to public reports, became a civil servant at the age of 24 and worked in the court, enjoying air conditioning and a government salary, arbitrarily reduced the compensation claim from 18,000 yuan to 9,000 yuan.

The victim was stunned on the spot. He was truly poor and couldn't even afford to stay in the hospital, so he had to go home to recover. He felt that the 18,000 yuan claim was a very reasonable request for a law-abiding citizen who had experienced a car accident requiring "29 days of hospitalization as per medical advice." The victim felt he was not trying to extort money because everyone who has dealt with traffic accident claims knows that compensation usually only covers visible injuries and requires strict documentation. Whether you were discharged early due to inability to pay medical bills, whether you have long-term sequelae requiring readmission, lost wages, or commuting costs, or whether your family was starving while you were hospitalized, the judgment likely wouldn't consider these factors.

But Judge Wang Jiajia, this "little fairy" judge born in 1987 who has been on the public payroll almost since graduation, managed to cut the victim's compensation claim in half, even though the driver was entirely at fault and the insurance company admitted liability.

I don't want to speculate maliciously about Judge Wang's motives, but apart from thinking she was out of touch with reality and maliciously retaliated because the "victim lowered her people's mediation KPI," I cannot fathom why Judge Wang acted this way.

It was as if her motto was: "If you increase my workload and lower my performance, I will cut your compensation."

Then, Judge Wang Jiajia was murdered by the victim of the traffic accident case, her throat slit.

May the court in the underworld render a just verdict on the life of Ms. Wang Jiajia. May those who dine at the public trough retain a shred of humanity when facing those who are starving.
