中国人权律师团声明:强烈谴责南昌当局再次把李宜雪强制送精神病院

2024年12月22日,南昌市公安局西湖分局和西湖区南浦街道办事处联合通报:李宜雪被街道社区依法依规送诊。

我们不禁要问: 一、李宜雪再次被送诊,送到了哪个精神病院? 二、官方称依法依规送诊,依的是哪条法规? 三、侮辱诽谤是自诉案件,筷子巷派出所为什么介入李宜雪和他人的纠纷? 四、家属对李宜雪被送诊的情况是什么态度,能否由第三方独立采访并公开披露?

李宜雪在几乎一边倒的社会舆论支持下仍然再次被强制关入精神病院引发全网关注,而这一次她能否精神正常地走出精神病院牵动着亿万网友的心。很多人感慨,超过10亿的流量和举国之力救不了一个李宜雪。

其实这种悲剧性的结局在近年早已上演不止一次。2022年初和2023年初,举国关注和几十亿的流量同样不能让铁链女获得自由,也逼不出胡鑫宇的失踪和死亡真相。当然,与身陷囹圄的铁链女和阴阳两隔的胡鑫宇相比,李宜雪还算是幸运,她拥有着蓬勃的生命、灿烂的年华、率真的个性和自由的生活,当她遭遇不公时,她尚有机会利用法律为自己申张权益,能利用网络对邪恶体制进行舆论反击。李宜雪在对抗暴政中展现出的勇气与真性情,给当代中国社会留下了一幅浓墨重彩的宝贵画卷。

率真的李宜雪可能并不清楚,10亿的播放量不但未能救她,恰恰是她被二次强制关 入精神病院消息的网络流量。当局所针对的已经不是她李宜雪个人,而是针对社会舆论和普遍的民意树立暴力机关和暴力政权的权威,反映的是独裁者的傲慢和霸道!借用他们抨击前苏联迫害异议人士的一句话:为了在国内强化法西斯专政,他们加紧利用“精神病院”作为镇压人民的工具。他们对不满和反抗其反动统治的持不同政见者扣上“精神病”的帽子后投入“精神病院”任意迫害,其手法之残暴比希特勒当年的集中营和监狱有过之而无不及!

李宜雪事件的网路反应。

前媒体人赵兰健12月20日在X上发帖说:“江西省公安系统一直是以黑社会的方式强 加管制敏感案件,李宜雪已被江西省公安系统迫害致残。胡鑫宇案件也是江西省公安厅一手操办的糊弄老百姓的冤假错案。李宜雪举报江西省精神病院,揭示了中共利用精神病院,作为国家暴力工具迫害普通生命。李宜雪旁证出中共系统正在实施反人类行为,应受到法庭审判,追究中共的反人类行为的责任。尽早制止中共系统再继续作恶迫害普通人的生命。”

曾经遭受当局精神病院折磨的界立建12月23日在X上发帖说:“每一次揭开自己被关 押精神病迫害的痛苦伤疤,每一次都是痛苦的回忆,痛得喘不过气来。精神病医院的暴徒护工们比看守所监狱恶警还要凶残歹毒万倍、精神病院最邪恶的手段就是抽取你脑脊液、人为制造成痴呆植物人,逼迫家属签字接出医院,不到一年受害者就去世。进入医院一刻对你的各种检测包括血常规、心电图、磁共振CT、抽取大量血液、验尿等各种检测都是在为供体配型做准备,精神病院……更是器官买卖的交易市场。”

中国法律学者杜文12月23日在X上发帖说:“我们必须明确地指出:在任何一个正常的社会,若存在独立的司法、媒体监督、以及对公权力的有效制衡,就不可能出现这种’想关谁就关谁’的情形。可是为什么在中国屡见不鲜?为什么类似的事情还一直在不断重演?为什么在这片土地上,针对‘被精神病’的控告几乎没有一例能获得真正公正的审判?这背后的根源正是中共长期的极权统治!正是它建构起一整套高压维稳体系,使得无数黑箱操作有恃无恐,使得医院、公安、地方政府与其穿一条裤子、互相勾结,把公民最基本的自由与尊严践踏在脚下。”

共产暴政的产物,通过精神病院迫害民众由来已久。

早在2002年,著名民主人士胡平就写过一篇专著《谁是疯子——政治迫害的新招 术》,揭露从苏联时代一直到中共如何利用精神病院对民众实施政治迫害。胡平在文章中写道:“以精神病的名义实行政治迫害,这种迫害有两大特点:第一,它罔顾法律,绕开法律,没有判罪的名义,却有判罪的效果。实际上是法外施刑,比那些以法律的名义治罪的方式还更狡猾、更阴险、更无耻。第二,关进精神病院常常比关进监狱还更残酷,因为它可以在治疗的名义下用药物和其它物理手段(如用电棍进行所谓休克治疗)直接破坏人的神经系统,摧残人的精神。事实上,它不是把精神病人治好成正常人,而是把正常人治坏成精神病。若问这些异议人士、工运人士或法轮功成员真的是精神病、是疯子吗?不是,肯定不是。如果真是疯子,当局倒不会把他们关进精神病院了。”

胡平说:“七十年代,苏联著名异议人士麦德维耶夫写过一本书《谁是疯子?》,揭 露了苏联克格勃利用精神病院折磨迫害各种异议人士的严重罪行。如今,当局继承其衣钵,变本加厉,虽然眼下我们还没有完整系统的披露,但仅就我们已经知道的零星事实,足以令人触目惊心。”

资深媒体人郭君在近期的一期《菁英论坛》节目中表示,中共当局很早就设立了专门的精神病医院――安康医院,并且把政治异议人士关押在里面,这个医院的主管单位就是公安局。郭君说:“中共是在1987年左右开始设立安康医院的,有意思的是很多其它的医院也自称是安康医院,但公安部绝对不会去禁止别人用这个名词,所以就真真假假混在一起。

1990年有一个文件特别强调说,有三种疯子公安机关可以把他们送进精神病院,第一种叫做花疯子,就是流浪汉;第二种是武疯子,就是犯病的时候会动武的;第三种叫做政治疯子,包括贴政治标语、喊政治口号的人。”

郭君说:“这次李宜雪被关进的江西省精神病院,是不是这种安康医院,我们现在还不知道,但现在已经不重要了,因为所有的精神病院,都百分之百和公安员警有配合。现在所谓的政治疯子已经不只是贴标语或者喊口号,有其它的政治言论和文章也 可以送到精神病院,这也就是前苏联的做法。”

李宜雪被精神病事件反映了中共体制之恶。

李宜雪最初被送入精神病院是因为她说出了辅警猥亵的真相,被送入精神病院是当局封口和进行惩戒的标准程序,也是中共邪恶体制的基本运作模式。李宜雪出院后将江西省精神病院告上法庭,是要告诉人们真相:自己不是精神病,是正常人。在打官司以及在与警方交涉的过程中,李宜雪拒绝接受私了,她要求通过法律得到一个公道,这依然是率真的体现。

凡是在性格中保持着率真天性的那些人,都相信世界上应该存在且必须存在着公平、公正、公道,认为这就是我们这个世界运行的底层逻辑和崇高真理。如果世界失去了这些基本价值观,失去了这些底层逻辑和真理的光芒,那我们就必须把它们恢复出 来,以让人们生活的有尊严、有骨气、有秩序、有希望,这也是我们人类在这个世界存在的基本意义。

李宜雪在视频中表现出她是一个不虚伪、不媚俗、不愿被潜规则之人,是一个试图按照普世原则率真生活的正常人。然而以谎言和暴力为底层逻辑构筑的中共邪恶体制一定要打压、封口甚至灭口这样的正常人。中共依然试图将秉持率真个性的正常女孩李宜雪“鉴定”为精神病。只要中共的暴政依然存在,发生在中国人身上的这些悲剧就不会终止。

我们关注李宜雪事件的意义。

对一个人的不公就是对所有人的威胁,我们关注李宜雪就是希望我们自己哪一天不经我们本人或者家属同意,当局不敢把我们拖进精神病院。李宜雪未来的命运让无数人牵挂,已经成为中国当代历史的一个标志性事件。李宜雪点燃的光亮不会熄灭,因为它是无数前人早已点亮的那盏神圣火炬的传递和延续,是普世文明的火种在当代中国人心中不灭的体现。

Statement by the Chinese Human Rights Lawyers Group: Strong Condemnation of Nanchang Authorities for Forcibly Sending Li Yixue to a Psychiatric Hospital Again

On December 22, 2024, the Xihu Branch of the Nanchang Public Security Bureau and the Nanpu Subdistrict Office of Xihu District jointly announced: Li Yixue was sent to the hospital by the street community according to laws and regulations.

We cannot help but ask:

Where has Li Yixue been sent this time, and which psychiatric hospital is involved? The authorities claim the transfer was done according to laws and regulations—what specific law or regulation justifies this? Defamation is a private prosecution case, so why did the Kuai Zixiang Police Station intervene in the dispute between Li Yixue and others? What is the family’s stance on Li Yixue being sent to the hospital? Could independent third-party interviews and disclosures shed light on this matter? Despite overwhelming public support for her, Li Yixue has once again been forcibly sent to a psychiatric hospital, triggering widespread concern across the internet. This time, millions of people are anxiously hoping she can leave the hospital mentally intact. Many lament that even with over a billion views and nationwide attention, one Li Yixue cannot be saved.

Such tragic outcomes are not unprecedented in recent years. In early 2022 and early 2023, widespread public attention and tens of billions of views could neither secure freedom for the "chained woman" nor uncover the truth about Hu Xinyu’s disappearance and death. However, compared to the imprisoned chained woman and the late Hu Xinyu, Li Yixue is relatively fortunate. She is young, vibrant, candid, and living freely. When she encounters injustice, she has the opportunity to use the law to defend her rights and leverage the internet to fight back against an oppressive system through public opinion. The courage and sincerity Li Yixue has shown in her resistance against tyranny have left a powerful and invaluable legacy in contemporary Chinese society.

Perhaps candid Li Yixue does not realize that the billion views have not saved her; rather, they have fueled the attention surrounding her second forced hospitalization. The target of the authorities is no longer just Li Yixue as an individual but rather an effort to assert the authority of violent institutions and regimes over public opinion and societal sentiment. This reflects the arrogance and tyranny of dictators. To borrow their own criticism of the former Soviet Union: “To strengthen fascist dictatorship domestically, they intensify their use of 'psychiatric hospitals' as tools to suppress the people.” Labeling dissidents as "mentally ill" and incarcerating them in psychiatric hospitals constitutes persecution comparable to, if not worse than, Hitler's concentration camps and prisons.

Online Reactions to the Li Yixue Incident Former journalist Zhao Lanjian posted on X (formerly Twitter) on December 20: “The Jiangxi provincial public security system has always handled sensitive cases in a mafia-like manner. Li Yixue has been persecuted to the point of disability by the Jiangxi Public Security Bureau. The Hu Xinyu case was also a fabricated sham orchestrated by the Jiangxi Public Security Department to deceive the public. Li Yixue’s exposure of Jiangxi’s psychiatric hospital reveals how the CCP uses psychiatric hospitals as tools of state violence to oppress ordinary citizens. Li Yixue’s testimony shows that the CCP system is committing crimes against humanity. This system must face judicial scrutiny and accountability to stop its atrocities against ordinary people.”

On December 23, Jieli Jian, who has also suffered from psychiatric hospital abuse, posted on X: “Every time I reopen the scars of being confined and abused in a psychiatric hospital, it’s a painful reminder, suffocating in agony. The caregivers in psychiatric hospitals are a thousand times more vicious than prison guards. The most evil tactic is to extract spinal fluid, turning victims into vegetative states or mentally disabled individuals, forcing families to sign for their discharge, and leaving them to die within a year. The so-called medical tests—bloodwork, CT scans, MRIs, urine tests—are often preparation for organ matching. Psychiatric hospitals are trading hubs for organs.”

On December 23, Chinese legal scholar Du Wen posted on X: “In any normal society, with independent judiciary oversight, media scrutiny, and effective checks on public power, such arbitrary detentions would not occur. But why are such incidents so rampant in China? Why do they keep happening? And why are lawsuits challenging wrongful ‘psychiatric detentions’ almost universally denied justice? The root lies in the CCP’s long-standing authoritarian rule. Its high-pressure stability maintenance system enables unchecked abuses, allowing hospitals, police, and local governments to collude and trample on citizens’ basic freedoms and dignity.”

The CCP’s Use of Psychiatric Hospitals for Political Persecution As early as 2002, renowned pro-democracy activist Hu Ping authored a monograph, Who Are the Lunatics? A New Tool of Political Persecution, exposing how both the Soviet Union and the CCP have used psychiatric hospitals for political persecution. Hu Ping wrote: “Political persecution in the guise of psychiatric treatment has two distinctive features. First, it bypasses the law and imposes extrajudicial punishment. It is even more cunning, insidious, and shameless than legal sentencing. Second, confinement in psychiatric hospitals is often more brutal than imprisonment because it involves using drugs and physical methods under the guise of treatment, directly destroying people’s nervous systems. This doesn’t cure normal people into health but instead turns them into the mentally ill.”

Significance of the Li Yixue Case An injustice to one is a threat to all. Our concern for Li Yixue is also a defense against being dragged into psychiatric hospitals without consent. Li Yixue’s fate has captured widespread concern and stands as a landmark event in contemporary Chinese history. The light sparked by Li Yixue will not be extinguished, for it represents the continuation of a sacred torch passed down through generations—a testament to universal civilization burning in the hearts of contemporary Chinese people.
